Scope of Services

1. The services include

   1. A tutor with expertise relevant to and appropriate for the needs of the Client.

   2. Individual or group tutoring sessions, occurring at times and locations as negotiated between the Tutor and the Client, and scheduled using the Illawarra Tutoring website.

   3. Detailed lesson reports provided on the Illawarra Tutoring website.

2. The services do not include

   1. Guarantees of a final result or grade.

   2. The supply of any goods or services not scheduled through the Illawarra Tutoring website.

Payment and Payment Terms

1. Scheduled tutoring is funded by an account balance of pre-purchased credit, which will be kept securely and transparently up to date by Illawarra Tutoring.

2. The Client’s account balance will be debited the cost of a tutoring session only once that session has been marked complete and the lesson report provided by the Tutor.

3. When cancelling scheduled tutoring, the Client agrees that they must provide the Tutor with at least 24 hours notice. In the event of a cancellation with less than 24 hours notice, the Client agrees their account balance will be charged the full cost of the tutoring session.

4. The Client agrees that they will maintain a positive account balance, and that in the event of a negative account balance Illawarra Tutoring reserves the right to charge the Client’s account balance a $10 administration fee and suspend scheduled tutoring until the negative account balance is paid.

5. The Client agrees that a negative account balance represents a debt of the Client to Illawarra Tutoring, and that negative account balances are required to be paid back in full.

6. Illawarra Tutoring agrees they will endeavour to communicate to the Client that their account balance needs payment with reasonable notice before charging the $10 administration fee.

Refunds

1. Refund of completed tutoring sessions

   1. Tutoring sessions which do not fulfill the scope of services as defined in this agreement may be eligible for a refund. To seek a refund the Client will contact Illawarra Tutoring in accordance with the Dispute Resolution section of this agreement.

   2. Refunds of eligible sessions will be rendered as a return of credits to the Client’s existing account balance, including any administration fee which may have been incurred as a result of the session.

2. Refund of purchased account balance

   1. Illawarra Tutoring agrees to refund the balance of a Client’s pre-purchased credits in the event that the Client requests a closure of their account.

   2. This refund does not include any credit the Client has received for any reason except for the purchase of credits with Australian Dollars.

Confidential Information

1. The Client acknowledges some personal information collected by Illawarra Tutoring will be stored on the online booking system on the Illawarra Tutoring website.

2. Illawarra Tutoring confirms it will not disclose any personal or confidential information of the Client or any related entity to any third party, with the exception of providing to a Tutor any information necessary for the provision of tutoring services. This may include

   1. The Client’s phone number and email address

   2. The name, date of birth, school, and overall grade of students under the Client’s account

   3. The postcode of the student’s home address

Liability

1. The Client acknowledges that while believed to be accurate, all information provided, or found on the Illawarra Tutoring website may be incorrect, out of date, or inaccurate to some degree.

2. Illawarra Tutoring acknowledges the rights of the Client as a consumer under the Australian Consumer Law.

3. The Client acknowledges that Illawarra Tutoring is not responsible for any loss, damage, or costs caused in the event that a Tutor cannot be provided.

4. The Client acknowledges that Illawarra Tutoring is not responsible for any loss, damage, or costs caused by advice or actions of the Tutor.

Dispute Resolution

1. In the event of a dispute between the Client and a Tutor, Illawarra Tutoring will act as a mediator. To initiate a Dispute, the Client or Tutor must provide details in writing to Illawarra Tutoring to open discussions.

2. In the event of a dispute between the Client and Illawarra Tutoring, the initiating party must formally notify the other of any conflict or disagreement in writing at least 2 weeks before commencing legal proceedings, and participate in negotiations to resolve the problems before escalating.

Termination

1. Either party may terminate this agreement at any time in writing.

2. Termination of the agreement will not prejudice any rights or remedies already accrued to any party under due press of law, or in respect of, any breach of this agreement.

3. The Client agrees that during the term of this agreement, and for a period of 12 months thereafter, it will not directly or indirectly endeavour to entice away from Illawarra Tutoring or any of its related entities any person or organisation who is a Client, Employee, Customer, or Independent Contractor of Illawarra Tutoring or any of its related entities.
